Conservatorships

Getting the rights you need

The State of California allows, in certain situations, an adult to obtain the legal right to make personal, financial, and legal decisions for another adult. This process is called a conservatorship and is issued by a court order. Conservatorships and guardianships are essentially the same thing, however the former is for adults while the latter is for minors.

There are three main types of conservatorships:

  • Probate Conservatorships. These conservatorships generally involve an incapacitated adult, usually an elderly individual, or a developmentally disabled individual. Common causes that necessitate such a conservatorship are dementia, Alzheimer’s disease, and other debilitating diseases.
  • Limited Conservatorships. This process creates a narrower scope of duties and responsibilities for the conservator. Limited conservatorships are designed for children who are have certain diseases, handicaps, or developmental disabilities such as Autism or Down Syndrome.
  • LPS or Mental Health Conservatorships. This type of conservatorship is unique and is necessary when an individual has serious mental health issues or addictions, like alcoholism or drug related addictions.

Note that each conservatorship is divided into subparts. In addition, each conservatorship can be either broad or narrow. The court can award a conservatorship of the person, of the estate or of both.

Conservatorships are necessary when proper estate planning procedures, like powers of attorney, are not followed. Conservatorships are delicate procedures and require attention to detail and understanding.
